Social Security Disability

You may have patients who have questions about Social Security Disability. Whether your patient is entitled to Social Security benefits depends on many factors. If your patient obtains disability benefits, he or she may also qualify for Medicare or Medicaid benefits.

The regulations require the presence of medically determinable impairment, which has lasted or is expected to last 12 months (or result in death) and which causes physical and/or mental limitations which prevent an individual from engaging in substantial gainful activity. Age, education, and work experience are considered in determining eligibility for benefits.

Some of your patients who are not permanently disabled may qualify for Social Security disability if they are not able to work for 12 months. They may qualify for monthly payments; for retraining; and for a trial work period to determine if they can work.

Our practice specializes in representing persons temporarily or permanently disabled who are seeking Social Security disability. We only get fees if the Claimant receives benefits. The fees are limited by Social Security Law.

We are the bridge between the requirements of the decision maker (who applies Social Security regulations) and the treating clinician's knowledge of his or her patient's medical condition. Our attorneys and staff are able to translate your patient's physical and mental condition into the terms used in the regulations and required by the Social Security decision maker.
